1. Acceptance of Terms

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Booking and Reservations

2.1 Reservation Process: All reservations must be made through our authorized booking channels. A reservation is confirmed only when you receive written confirmation from us.

2.2 Payment: Full payment or a deposit (as specified at the time of booking) is required to secure your reservation. We accept major credit cards and other payment methods as specified.

2.3 Minimum Age: The person making the reservation must be at least 21 years old and must occupy the property during the rental period.

3. Cancellation and Refund Policy

3.1 Cancellation by Guest:

• Cancellations more than 30 days prior to check-in: Full refund minus a 10% administrative fee
• Cancellations 15–30 days prior to check-in: 50% refund
• Cancellations less than 15 days prior to check-in: No refund

3.2 Cancellation by Us: We reserve the right to cancel any reservation due to unforeseen circumstances. In such cases, we will provide a full refund of all payments made.

4. Property Use and Guest Responsibilities

4.1 Occupancy Limits: The number of guests may not exceed the maximum occupancy specified for the property without prior written approval.

4.2 Property Care: Guests agree to:

• Treat the property with care and respect
• Leave the property in the same condition as found
• Report any damage or issues immediately
• Follow all property rules and local regulations
• Not engage in illegal activities on the property

4.3 Prohibited Activities: The following are strictly prohibited:

• Smoking inside the property (unless specifically designated)
• Parties or events without prior written approval
• Pets (unless specifically allowed)
• Subletting or assigning the reservation to others

5. Check-In and Check-Out

5.1 Check-In Time: Standard check-in is 3:00 PM. Early check-in may be available upon request and subject to availability.

5.2 Check-Out Time: Standard check-out is 11:00 AM. Late check-out may be available upon request and may incur additional fees.

5.3 Access: You will receive check-in instructions and access information prior to your arrival.

6. Damage and Security Deposit

A security deposit may be required for certain reservations. This deposit will be returned within 7 days after check-out, minus any deductions for damages, extra cleaning, or violations of these Terms.

7. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any injury, loss, claim, damage, or expense arising from your use of the property
• Guests use the property and amenities at their own risk
• We are not responsible for loss or damage to personal belongings
• We are not liable for any failure or delay caused by circumstances beyond our reasonable control

8. Insurance

We strongly recommend that guests obtain travel insurance to cover trip cancellation, interruption, medical emergencies, and personal liability.

9. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, governmental actions, or other force majeure events.

10. Privacy

Your use of our services is also governed by our Privacy Policy. Please review it to understand our practices.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Florida.

14. Entire Agreement

These Terms, together with our Privacy Policy and any reservation confirmation, constitute the entire agreement between you and Varney Vacation Club LLC regarding your use of our services.
